Terms of Service

By accessing or using BudAbout(the "Service"), you agree to be bound by these Terms of Service (the "Terms") and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 21 years old to use the Service. BudAbout publishes information about cannabis products and licensed dispensaries in New York, and cannabis is restricted to adults 21 and over. By using the Service you represent that you are 21 or older and legally permitted to view this content where you are located. If you are under 21, you may not use the Service, and you must leave the site.

We may update these Terms from time to time (see Changes to these Terms below). Your continued use of the Service after a change takes effect means you accept the revised Terms.

Some features require an account. When you create one, you agree to:

• Provide accurate, current, and complete information, and keep it up to date.
• Keep your login credentials confidential. You are responsible for everything that happens under your account, whether or not you authorized it, so choose a strong password and do not share it.
• Maintain one account per person. Accounts are personal and may not be shared, sold, transferred, or operated on behalf of anyone else.
• Notify us promptly at [email protected] if you believe your account has been accessed without your permission.

We may refuse, suspend, or close an account at our discretion, including where we reasonably believe these Terms have been violated.

The Service lets you post content such as ratings, reviews, and comments ("User Content"). You keep ownership of your User Content. You are solely responsible for what you post and for making sure you have the right to post it.

By posting User Content, you grant BudAbout a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt (for formatting and moderation), and otherwise use that content in connection with operating, promoting, and improving the Service. This license lets us show your review across the site and in related features; it ends when you delete your content or account, except for copies retained in routine backups or where the content has already been shared by others or is required by law.

You agree not to post content that is:

• False, misleading, or fraudulent, including fake reviews.
• Abusive, harassing, threatening, hateful, defamatory, or invasive of someone's privacy.
• Illegal, or that promotes illegal activity — including any sale, marketing, or provision of cannabis to minors or any cannabis sale outside New York's licensed, regulated market.
• Spam, advertising, or unsolicited promotion, or that impersonates another person or entity.
• Infringing on anyone's intellectual property or other rights, or that contains malware.

We may — but are not obligated to — review, moderate, edit, or remove any User Content, and we may suspend or terminate accounts, at our discretion and without notice, where content violates these Terms or where we otherwise consider it necessary to protect the Service or its users.

Except for User Content, everything on the Service — including our editorial reviews, neighborhood guides, articles, product inspections, terpene and aroma tools, data compilations, design, logos, and the BudAbout name and branding — is owned by BudAbout or its licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-transferable, revocable license to access and use our content for your own personal, non-commercial use. You may not copy, republish, sell, distribute, or create derivative works from our content without our prior written permission.

When using the Service, you agree not to:

• Scrape, crawl, harvest, or bulk-download content for resale, redistribution, or to build a competing or derivative dataset or product.
• Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, its servers, or its networks, including through bots, denial-of-service attempts, or security circumvention.
• Reverse engineer or attempt to extract source code, except where that restriction is prohibited by law.
• Use the Service to violate any law, or to facilitate any cannabis transaction outside New York's licensed market or with anyone under 21.

Reasonable, good-faith use by search engines and other standard web crawlers in accordance with our published robots.txt is permitted.

BudAbout is an information and review service. It is not a dispensary, and we do not sell, deliver, broker, or facilitate the sale of cannabis.

• We inspect — we don't lab-test. Our product checks are visual and sensory inspections (appearance, structure, trim, aroma) and consumer reviews. They are not laboratory testingand are not a substitute for a licensed lab's certificate of analysis.
• No health, medical, or effect claims. We make no claims about health benefits, medical uses, potency effects, or outcomes of any product. Descriptions of aroma and flavor only are just that — sensory descriptions, not promises about how a product will affect you.
• Producer-reported figures. Any THC, CBD, or other cannabinoid or terpene figures shown are reported by the licensed producer and are not measured or verified by BudAbout. We do not guarantee their accuracy.
• Buy only from licensed dispensaries. Purchase cannabis only from New York dispensaries licensed by the Office of Cannabis Management. You can verify a license at cannabis.ny.gov. Buying from unlicensed sellers is unsafe and unlawful.
• General information only. The Service provides general information for adults 21+. It is not legal advice and not medical advice. For guidance about your situation, consult a qualified professional.

"As is."The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information on it is complete or accurate.

Limitation of liability. To the fullest extent permitted by law, BudAbout and its owners, operators, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service. To the extent any liability is not excluded, our total liability to you for all claims will be limited to the greater of the amount you paid us to use the Service in the twelve months before the claim, or one hundred U.S. dollars ($100).

Indemnity. You agree to indemnify and hold harmless BudAbout and its owners and operators from reasonable claims, damages, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to [email protected] that includes: (1) identification of the copyrighted work; (2) the URL or location of the allegedly infringing material; (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature. We will respond to valid notices and may remove the material and/or terminate repeat infringers.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New York will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there.

Changes.We may update these Terms as the Service evolves or the law changes. When we do, we will revise the "last updated" date above and, for material changes, take reasonable steps to notify you. Your continued use after changes take effect means you accept the updated Terms.

Termination. You may stop using the Service at any time and may request that we delete your account. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnity, and governing law — will survive.
